China Tax Overview

1. Overview


The tax system in China is primarily based on Value Added Tax (VAT) and Corporate Income Tax (CIT), and is composed of various tax categories such as consumption tax, individual income tax, resource tax, and urban construction tax. VAT targets a wide range of transactions including manufacturing, distribution, services, and imports/exports, and accounts for the largest share of total tax revenue, thus supporting the foundation of China's fiscal system. CIT, following the implementation of the new tax law in 2008, applies a single tax rate of 25% to both domestic and foreign-invested enterprises, with preferential tax rates such as 15% granted to high-tech enterprises and companies in the western development regions. Although individual income tax is levied at progressive rates, its share of total tax revenue is small, with resource tax and land use tax supplementing local financial resources.

Value Added Tax (VAT)

China's Value Added Tax (VAT) is an indirect tax levied on the sale of goods, provision of services, transfer of intangible assets, and real estate transactions, similar to the VAT systems adopted in European countries and Japan's consumption tax, which taxes the value added by businesses. Businesses deduct the Value Added Tax (Output VAT) received from customers at the time of sale from the Value Added Tax (Input VAT) related to purchases and expenses, and pay the difference to the tax authorities. The tax rates mainly applied are 13% (for goods sales, etc.), 9% (for real estate, transportation, etc.), and 6% (for services, intangible assets, etc.), and a zero tax rate is generally applied to export transactions, allowing for refunds of the Value Added Tax paid on purchases under certain conditions.


Corporate Income Tax (CIT)

The basic tax rate is 25%, but a preferential tax rate of 15% applies to high-tech enterprises, advanced manufacturing, transportation infrastructure, and environmental protection projects. Policies to reduce the effective tax rate to around 5-10% for small and low-profit enterprises have been extended until 2027, alleviating the tax burden. Additionally, foreign companies without a permanent establishment or business location in China are subject to a 10% withholding tax on China-sourced income.


Individual Income Tax (IIT)

A progressive tax rate of 3-45% applies to salary income, while fixed tax rates are set for dividends, interest, and royalty income. Tax obligations vary based on the duration of stay and employment type for foreigners, making tax management for expatriates an important consideration.


Local Taxes and Other Taxes

The urban maintenance and construction tax, education surcharge tax, land use tax, and stamp tax are major sources of revenue for local governments, and various taxes are applied depending on the nature of the business. When acquiring land or investing in real estate, it is also necessary to consider land appreciation tax and deed tax.

Tax response to frequent system revisions

The State Council and the National Taxation Administration frequently issue notices, and changes to tax rates, reporting methods, and preferential policies occur almost every year. There are many special provisions for different industries and regions, so regular information updates are essential.


Management of the tax calendar

VAT and Individual Income Tax are usually declared and paid monthly, while CIT is provisionally declared quarterly and the annual declaration must be completed by the end of May of the following year. Since online application is mandatory through the electronic filing system (E-tax), proper account setup and designation of a representative are required.


Avoidance of double taxation and transfer pricing

Companies with an international business structure need to harmonize the tax systems of both China and their home country. It is recommended to minimize tax risks and economic burdens through transfer pricing documentation and the use of bilateral APAs (Advance Pricing Agreements). However, it is important to note that the process from application to result for bilateral APAs can take an extremely long time.
